eSimy LLC (Delaware, USA), and
eSimy LLC (Kosovo).
Your contracting entity depends on your location:
If you are located in the European Union, European Economic Area, or the United Kingdom, your contract is with eSimy LLC (Kosovo).
If you are located outside of Europe, your contract is with eSimy LLC (Delaware, USA).
By accessing our website and purchasing our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must stop using the website and our services immediately.
You agree to use our eSIM services only for lawful purposes and in accordance with these Terms. You may not:
Use our services in any way that violates any applicable local, national, or international law or regulation.
Use our services for any fraudulent, deceptive, unlawful, or harmful activity, including but not limited to spam, hacking, phishing, or distribution of illegal content.
Use our services to transmit any unauthorized advertising or promotional material.
Use our services to harm or attempt to harm minors in any way.
Interfere with or disrupt the proper functioning of our website or services.
Our eSIM services are intended for normal, personal, and reasonable use. The vast majority of customers will never be affected by this policy—it is designed only to prevent network abuse that could negatively impact other users.
Examples of activity that may be considered excessive or abusive include, but are not limited to:
Continuous or automated high-volume data transfers that place an unusually heavy load on the network.
Using the service in ways that mimic or replace fixed broadband connections for long periods (e.g., running a permanent hotspot to replace home Wi-Fi).
Activities such as server hosting, large-scale machine-to-machine connections, or other non-personal uses.
Reselling or sharing the connection with multiple unrelated users.
Hotspot/tethering is allowed on our plans. This policy is only applied if tethering is used in an extreme way that impacts network performance for others.
We reserve the right to take reasonable steps—such as managing network traffic, reducing speeds, or limiting access—only in cases where usage is clearly excessive, abusive, or detrimental to the network. Such measures are rare and are applied solely at our discretion to protect service quality for all customers.
To use certain services, you may be required to register for an account. You must provide accurate and complete information when registering, and you are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately if you suspect any unauthorized use of your account.
Our eSIM services provide data plans and connectivity for compatible devices. The availability of these services may vary by location. You are responsible for ensuring that your device is compatible with our eSIM services. We are not responsible for any issues arising from device incompatibility.
Delivery of eSIMs is instant in most cases, with activation details sent automatically via email immediately after successful payment. In rare cases where there is a technical or processing issue, our support team will work to deliver your order as quickly as possible, always aiming for immediate delivery.
All payments for eSIM services must be made through the payment methods available on our website. Payment processing is handled by one or more third-party payment service providers, who process transactions securely in accordance with industry-standard security practices.
We do not store any sensitive payment information (such as credit card numbers) on our servers. Your use of a given payment method may also be subject to the terms and privacy policy of the respective payment service provider.
You agree to pay all fees and charges associated with your purchases. We reserve the right to change our prices at any time, but any price changes will not affect purchases already made.
Refunds are only issued if the issue is caused by us (e.g., technical problems preventing activation or service usage or when a customer’s device doesn’t support it, even though we have a link on our site that helps customers to identify supported devices). If the eSIM has been activated successfully and the service is working as intended, no refunds will be issued. If you believe you are eligible for a refund, please contact our support team at support@esimy.net.
All content on our website, including text, graphics, logos, and software, is the property of eSimy LLC (Delaware), eSimy LLC (Kosovo), or their licensors and is protected by intellectual property laws.
To the maximum extent permitted by law, eSimy LLC (Delaware), eSimy LLC (Kosovo), and their affiliates will not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our website or services. This includes any loss of data, loss of profits, or interruption of services.
You agree to indemnify and hold eSimy LLC (Delaware), eSimy LLC (Kosovo), their officers, directors, employees, and agents harmless from any claims, damages, liabilities, and expenses arising out of your use of our services, your violation of these Terms, or your violation of any applicable law or regulation.

For customers in the EU, EEA, or UK, personal data is processed by eSimy LLC (Kosovo) in compliance with the EU General Data Protection Regulation (GDPR).
For customers outside Europe, personal data is processed by eSimy LLC (Delaware, USA) in compliance with applicable U.S. and international data protection laws.
Before initiating legal proceedings, you agree to first attempt to resolve any dispute by contacting us at support@esimy.net so that we may try to find an amicable solution.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the effective date at the top of this page or by other means. Your continued use of our services after any changes indicates your acceptance of the updated Terms.
For customers located in the United States and all regions outside Europe, these Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
For customers located in the European Union, European Economic Area, or the United Kingdom, these Terms are governed by and construed in accordance with the laws of the Republic of Kosovo, without regard to conflict of law principles.
Any disputes will be subject to the exclusive jurisdiction of the competent courts in the respective jurisdiction.
